In Law360: Avoiding The Rotten Compromise In Mass Litigations
Kennan Professor at the Institute for Advanced Study, in Princeton--claims that 'rotten compromises are not allowed, even for the sake of peace. But compromises tell us who we are. Provide[s] grist for thinking through the difficulties of compromise in [foreign policy], from tragic choices at desperate moments of history to the routine nastiness in American public life today. Recognizing that we are 'forced by circumstances to settle for much less than we aspire to' on issues of justice, we ought to be 'judged by our compromises more than by our ideals and norms. Ideals may tell us something important about what we would like to be.
Compromises are made everyday and everywhere: in marriages, families, business, politics, and science. Considering their irreplaceable role as a mechanism for resolving conflicts in both private and public life, the relative neglect of the notion of compromise in philosophy, political science, and sociology is astonishing. The ZiF conference aimed to partly fill this gap and to help understand the notion of compromise. The conference gathered twelve speakers from six countries and focused on four fields of application: Morality, politics, law, and religion. Of course these fields are not independent of each other: For example, political compromises and compromises in law have moral consequences and moral compromises are sometimes made in political or jurisdictional decisions.

Stalin was utterly ruthless in his disregard for the lives of his own subjects, which he tossed away by the million. The only people who fared worse were his enemies which included many of his own subjects against whom he unleashed campaigns of unimaginable vindictiveness. His was a truly horrible regime.
There is a void in International Relations literature. That void concerns the role of compromise in international affairs. The wide-ranging objective of this essay, therefore, is to bring to light this understudied phenomenon. I hope to do this by asking and answering an increasingly relevant question: when is compromise between international actors ethically acceptable? The argument implicitly pursued throughout is that ethical theory determines which compromises we view as ethically acceptable.
